TrustSta Terms of Service

Please read these Terms of Service ("Terms") carefully before using the TrustSta website and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and all incorporated terms. If you don't agree to these Terms, please don't use our Services.

These Terms govern your use of the TrustSta website at [www.truststa.com] and all associated services provided by TrustSta ("TrustSta," "we," "us," or "our"). This is a legally binding agreement between you and TrustSta.

2. Our Services

TrustSta offers these primary services:

  • Trading Plans: We provide various pre-designed investment strategies or "trading plans" that you can purchase. Each plan outlines a specific approach to market trading.
  • Managed Trading Services: After you purchase a trading plan, TrustSta will actively manage and execute trades on your behalf, using the capital you allocate to that plan. You explicitly authorize TrustSta to perform trading activities based on your chosen plan within your account.
  • Affiliate Program: We offer an affiliate program where you can earn commissions by referring new clients to TrustSta. Details for this program are in Section 6.

3. Your Account and Responsibilities

3.1 Eligibility

To use our Services, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction, if higher).
  • Have the legal capacity to enter into a contract.
  • Not be in any restricted jurisdiction (e.g., sanctioned countries) or otherwise legally prohibited from using our Services.

3.2 Account Registration

When you register for an account, you agree to:

  • Provide accurate, current, and complete information as requested.
  • Keep your account information updated.
  • Maintain the security of your password and identification.
  • Immediately notify TrustSta of any unauthorized account use or security breach.

You are solely responsible for all activities under your account.

  • Deposits and Withdrawals: We provide mechanisms for depositing funds for trading and withdrawing profits/capital. Withdrawal requests will be processed within specified timeframes, subject to verification and any applicable fees.

4.2 Acknowledging Investment Risks

By using our Services, you explicitly understand and accept the following risks:

  • Market Risk: Your investments' value can go down due to market fluctuations, economic conditions, political events, etc.
  • Loss of Capital: You could lose all or a significant part of your invested capital. TrustSta doesn't guarantee your principal investment's safety.
  • Leverage Risk: Trading with leverage can amplify both gains and losses. Small market moves can greatly impact your capital.
  • No Guarantees: TrustSta doesn't guarantee any specific returns, profits, or capital preservation. Past performance isn't an indicator of future results.
  • No Financial Advice: TrustSta provides managed trading services based on pre-defined plans. We don't offer personalized financial advice, investment recommendations, or tax advice. You are solely responsible for your investment decisions and for determining if our Services suit your financial situation.
  • Liquidity Risk: Some assets or markets might be illiquid, making it hard to exit positions quickly without significant loss.
  • Operational Risk: Risks related to trading operations, including system failures, human error, or cybersecurity breaches, despite our efforts to maintain robust systems.

You understand and agree that TrustSta is not responsible for any losses incurred from using our Services. Only invest funds you can afford to lose.

4.3 Tax Implications

You are solely responsible for all taxes, duties, and assessments arising from your investments and earnings through TrustSta. We won't provide tax advice.

5. Intellectual Property

All content on the TrustSta Website, including text, graphics, logos, images, software, and its design, is the exclusive property of TrustSta or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any material from our Website without our prior written consent.

6. Affiliate Program Terms

If you join the TrustSta Affiliate Program, you agree to:

  • Enrollment: You must apply and be approved by TrustSta. We can accept or reject any application at our sole discretion.
  • Commissions: Commissions are earned and paid according to the structure published on our Website or as agreed in writing. Commissions are typically for qualified new clients you refer who meet specific criteria (e.g., funding an account and purchasing a plan).
  • Marketing Conduct: You must promote TrustSta ethically and legally. You cannot engage in:
    • Spamming (unsolicited messages).
    • Misrepresenting TrustSta's services or terms.
    • Any illegal or unethical marketing.
    • Using TrustSta's trademarks or intellectual property without explicit permission.
  • Termination: TrustSta can terminate your participation in the Affiliate Program anytime, with or without cause, including for violating these Terms. Any unpaid commissions might be forfeited upon termination if the violation is severe.

8. Disclaimer of Warranties

TrustSta DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. TrustSta DOES NOT WARRANT THAT THE WEBSITE OR ITS SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, TrustSta, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO:

  • YOUR USE OR INABILITY TO USE THE SERVICES.
  • UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
  • INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES.
  • BUGS, VIRUSES, OR SIMILAR HARMFUL CODE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY.
  • ERRORS OR OMISSIONS IN ANY CONTENT OR ANY LOSS OR DAMAGE INCURRED FROM USING CONTENT ON THE SERVICES.
  • NEGLIGENCE OF TrustSta OR ITS EMPLOYEES, AGENTS, OR SUB-CONTRACTORS.

IN NO EVENT WILL TrustSta'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO TrustSta FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless TrustSta, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) they may incur due to your (or anyone using your account's) violation of these Terms or your use of the Services.

11. Termination

TrustSta may terminate or suspend your account and access to the Services immediately, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you can simply stop using the Services.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising from or relating to these Terms, or their breach, termination, or invalidity, will be settled by binding arbitration in accordance with the rules of [Specify Arbitration Body, e.g., "the Lagos Court of Arbitration"] and will take place in Ibadan, Oyo, Nigeria. TrustSta reserves the right to modify or replace these Terms at any time. If a change is material, we'll give you at least 30 days' notice before the new terms take effect. We'll decide what constitutes a material change. By continuing to use our Services after any revisions become effective, you agree to the new terms. If you don't agree, you're no longer authorized to use the Services.

14. Miscellaneous

  • Severability: If any part of these Terms is found unenforceable or invalid, that part will be limited or removed as necessary so that the rest of these Terms remain in full force and effect.
  • Entire Agreement: These Terms, along with the Privacy Policy and any other legal notices published by TrustSta on the Website, form the entire agreement between you and TrustSta regarding the Services.
  • Waiver: No waiver of any term in these Terms will be considered a further or continuing waiver of that term or any other term, and TrustSta's failure to assert any right or provision under these Terms won't be a waiver of that right or provision.
  • Assignment: You cannot assign or transfer your rights or obligations under these Terms without TrustSta's prior written consent. TrustSta can freely assign or transfer these Terms without restriction.
